These Terms of Service (“Terms”) govern your access to and use of the website and services operated by Beacheria GmbH under the brand TA-BOU (“we”, “us”, “our”), including all related information, content, articles, and services (the “Services”).

Our online store is powered by Shopify Inc., which provides the e-commerce platform enabling us to sell our articles and services.

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our Services.

1. Access and Eligibility

You confirm that you are at least 18 years old or the age of legal majority in your country of residence.

You agree to provide accurate, current, and complete information when placing an order or creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

Accounts may not be transferred, assigned, or resold.

2. Articles

We offer luxury beachwear and resort wear, 100% Made in Italy using Italian fabrics.

Certain articles are made to order and require approximately 4–6 weeks of production time unless otherwise stated.

Images and descriptions are illustrative. Colors, textures, and details may vary depending on screen settings and production characteristics.

We reserve the right to modify, limit, or discontinue articles at any time.

3. Orders and Contract Formation

Placing an order constitutes an offer to purchase.

A binding contract is formed only upon written confirmation of acceptance by us.

We reserve the right to refuse or cancel any order, including in cases of pricing errors, suspected fraud, or misuse.

Orders may not be cancelled.

Purchases are for personal use only and not for resale or commercial distribution.

4. Pricing, VAT, and Import Duties

Prices are displayed in the selected currency.

Unless otherwise stated, prices do not include shipping costs, customs duties, or foreign VAT.

For deliveries outside Switzerland, orders are shipped under DAP (Delivered At Place) terms. All import VAT, customs duties, and clearance fees are the sole responsibility of the customer.

We do not reimburse foreign VAT, customs charges, or related fees.

Swiss VAT is applied where legally required.

5. Shipping and Risk

Delivery times are estimates only and are not guaranteed.

Risk transfers to the customer upon handover of goods to the carrier.

We are not liable for delays caused by carriers, customs authorities, or events beyond our reasonable control.

6. Returns, Refunds, and Size Adjustment Courtesy

All sales are final.

We do not accept returns or provide refunds.

In limited circumstances and strictly at our sole discretion, an exception may be granted. Where approved, compensation will be issued exclusively as store credit valid for future purchases.

As a limited courtesy and without creating any obligation, we may offer a one-time size adjustment option, once per customer and article, subject to availability, exclusions, and specific conditions. This courtesy does not constitute a return, exchange, or refund and is governed exclusively by our Return Policy.

7. Intellectual Property

All content, trademarks, designs, images, text, and materials on the Services are the exclusive property of Beacheria GmbH or its licensors and are protected under Swiss and international intellectual property laws.

No content may be reproduced, distributed, or used without prior written consent.

8. Optional Tools and Third-Party Services

We may provide access to third-party tools or services. These are provided “as is” without warranties or endorsement.

We are not responsible for third-party services or external websites accessed through our Services.

9. Relationship with Shopify

Our store is powered by Shopify Inc. Purchases made through our website are transactions between you and Beacheria GmbH.

Shopify is not responsible for articles sold, order fulfillment, or customer disputes related to purchases made from our store.

10. Privacy

All personal data collected through the Services is governed by our Privacy Policy.

Because our Services are hosted by Shopify, personal data may be processed by Shopify and transferred internationally in accordance with applicable data protection laws.

11. Feedback

If you submit reviews, suggestions, or other feedback, you grant us a worldwide, royalty-free, perpetual license to use such content for business purposes.

You confirm that you have the right to provide such feedback and that it does not infringe the rights of third parties.

12. Errors and Inaccuracies

We reserve the right to correct any errors, inaccuracies, or omissions and to cancel orders if information is incorrect at any time.

13. Prohibited Uses

You may use the Services only for lawful purposes.

You may not violate applicable laws, infringe intellectual property rights, engage in fraudulent or harmful activity, or interfere with website security or functionality.

We may suspend or terminate access for violations.

14. Disclaimer of Warranties

The Services and articles are provided “as is” and “as available” to the fullest extent permitted by law.

Nothing in these Terms excludes liability where such exclusion is prohibited by applicable law.

15. Limitation of Liability

To the maximum extent permitted under Swiss law, Beacheria GmbH shall not be liable for indirect, incidental, or consequential damages.

Liability for unlawful intent or gross negligence remains reserved.

16. Indemnification

You agree to indemnify and hold harmless Beacheria GmbH and its service providers from claims arising from your breach of these Terms or misuse of the Services.

17. Severability

If any provision is deemed unenforceable, the remaining provisions remain valid.

18. Entire Agreement

These Terms constitute the entire agreement between you and Beacheria GmbH regarding the Services.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of Switzerland.

The exclusive place of jurisdiction is Zurich, Switzerland, subject to mandatory consumer protection provisions applicable in the customer’s country of residence where legally required.

20. Changes to These Terms

We may update these Terms from time to time. The version published on our website at the time of your use applies.
